eName Domain Registration Service Agreement

1. Introduction

Dear Users, welcome to use eName Technology Co.,Ltd. Services!

In order to better serve and regulate the behaviors of eName Technology Co.,Ltd. users, users should read and abide by the eName Domain Name Registration Service Agreement (hereinafter referred to as“this Agreement”) .

This Agreement is a revised version of the eName Domain Name Registration Service Agreement. From the effective date of this Agreement, unless otherwise expressly agreed, this Agreement will apply to the domain name registration service provided by eName Platform unconditionally.

2. Definition

2.1 Related definitions:

2.1.1 This Agreement refers to the Agreement between the User and eName Technology Co.,Ltd. (hereinafter referred to as “eName”) and the partner companies that may exist with related services regarding the use of domain name registration services at eName Platform; 

2.1.2 “User” means a natural or legal person who has full civil capacity to use the related services under this Agreement, and is more commonly referred to as “you” in this Agreement; If you are under the age of 18, please read this Agreement accompanied by a legal guardian and obtain the consent of your parents or legal guardian (hereinafter collectively referred to as "Guardians") before using the services of eName; 

2.1.3 eName Platform refers to the websites of ENAME.COM, ENAME.CN, ENAME.NET etc. and clients under the name of eName. Unless otherwise stated, they will be referred as the eName Platform;

2.1.4 eName Platform Domain Name Registration Service means that based on the Internet, includes various forms including the eName websites, client, APP, etc. (including the new service forms emerge from future technological developments), eName provides you with domain name registration service, including but not limited to submitting your domain name registration application to the domain name registry and assisting you with domain name registration, domain name usage and domain name management and other related services.

2.2 In order to protect the security of network information, protect the legitimate rights and interests of citizens, legal persons and other organizations, and safeguard national security and social public interests. According to the "Contract Law of the People's Republic of China" and other relevant laws and regulations, eName has formulated and provided related services in accordance with this Agreement.

2.3 eName reserves the right to modify the terms of this Agreement if necessary without prior notice. You can check the terms of the latest version of the Agreement on the corresponding service page.

3. Agreement Formation, Take Effect, Renewal and Scope of Application

3.1 User can confirm this agreement via eName platform or via other ways, including but not limited to use eName domain registration services without confirming this agreement. All of these mean that User and eName have agreed on this agreement and accepted all the agreed content of this Agreement.

3.2 This Agreement is effective as soon as the User confirms this Agreement. If the User does not click to confirm this Agreement, but in fact has already used eName services or fulfills this Agreement, then this Agreement will take effect when the User's factual act first occurs. 

3.3 eName may modify, supplement this Agreement and Platform rules, etc. from time to time in accordance with changes in national laws and regulations, maintaining of trading order, and protection of consumer rights. If you do not agree the modified agreement, supplementary agreement, and rules (hereinafter referred to as “Changes”), you have the right to contact eName for feedback before the effective date determined by the Changes. If the feedback is adopted, eName will adjust the Changes as appropriate; If you still disagree with the Changes that have already taken effect, you should stop using the eName Platform services from the effective date of the Changes, and the Changes will not affect you; If you continue to use the eName Platform services after the Changes have taken effect, you are deemed to have agreed to the Changes that have taken effect.

3.4 This Agreement includes the body of this Agreement and all the rules, specifications, notices and announcements (hereinafter collectively referred to as the “Rules”) of all the services of the eName Platform that have been released or may be released in the future. All Rules are an integral part of this Agreement and have the same legal effect as the body of this Agreement.

4. Registration Rules

4.1 You are required to comply with the relevant policies and regulations of the National Domain Name Authority, Domain Name Registry (including but not limited to any of the top-level domain name registries, such as CNNIC, etc.) , ICANN and the Uniform Domain Name Dispute Resolution (UDRP), etc.. In particular, it is necessary to strictly follow and fulfil the requirements of the domain name registries regarding the rights and responsibilities of domain name registrants, including but not limited to ICANN's “Registrant Rights and Responsibilities”. If the above laws, regulations and policies are changed or modified, you still need to comply with the changes.

4.2 After you submit your domain name registration application, whether you register successfully, whether, when and how to grant you ownership of the domain name, are determined by the domain name registries (such as CNNIC, etc.). If the domain name registry rejects the registration application, your registration fee will be refunded.

4.3 eName is a domain name registration service organization. You must ensure that the domain name registration information you submitted is true, legal, valid and complete; You must not impersonate others, use other people's information to register or manage domain names, and you must not maliciously use all domain names you register or own; Otherwise, eName reserves the right to stop providing services, freeze or cancel your eName account and/or domain names under your account immediately, and you must assume all responsibility arising therefrom.

4.4 After you register your domain name, you need to comply with the laws, regulations and policies to use the domain name, including but not limited to: you must not use the domain name to publish information prohibited by laws and regulations, you must not maliciously resolve to someone else's IP address or unauthorized IP address, or use the domain name for bad applications, etc., otherwise, eName has the right to stop domain name resolution and refuse to provide domain name services.

4.5 The domain name is valid from the date of registration to the date of expiration. During the validity period of the domain name, you can choose the domain name related services provided by eName. If you have not renewed the domain name after expiration, this registration Agreement will be terminated.

4.6 Before the domain name expiration date, you can renew the domain name according to the regulations. If the domain name registry accepts the renewal, the domain name validity period will increase accordingly. Please refer to the "eName Domain Name Renewal Service Agreement" for the relevant agreements and regulations on domain name renewal.

4.7 If the domain name is successfully registered, you can voluntarily apply for cancellation if it is not under Dispute or Lock, but the registration fee of the domain name will not be refunded after cancellation. To request a cancellation of a domain name, the domain name holder shall submit a legally valid domain name cancellation application and Identification materials to eName for review, the domain name shall be canceled upon approval by eName.

4.8 Due to business development needs or changes in the domain name registry policy, eName has the right to unilaterally modify, suspend, limit, terminate all or part of the content of this Agreement without notice. You are responsible for this risk.

5. Fees and Payment

5.1 You understand and agree that: To register a domain name, you need to pay the corresponding domain name registration fee. After the name domain name is successfully registered, you can request an invoice from eName. 

5.2 You understand and agree that: You must pay all necessary fees in full to eName on time . Failure to pay the full amount or provide the required qualified domain name registration information within the stipulated time will be deemed to automatically waive the registered domain name and shall bear all the liabilities arising therefrom.

5.3 You understand and agree that: eName provides you with free services including but not limited to privacy protection, domain name PUSH, display page, etc.; Regardless of whether you use the services offered or paid services, you must abide by national laws, administrative regulations, rules, social public ethics, and industry norms for computers and the Internet. Otherwise, eName has the right to refuse to provide services to you.

5.4 You understand and agree that: eName may modify and change the standards and methods of charging services according to actual needs; eName may also start to charge for some free services. Before the above modification, change or start of charging, eName will make notification or announcement at the corresponding service page. If you do not agree to the above modifications, changes or paid content, you should stop using the services; If you make a payment or use eName services, you have expressly agreed to accept eNames charging standards.

5.5 Regarding the payment under your account, you need to understand and agree to the following:

5.5.1 You can select a payment method via the instruction on the payment page. If you choose to top up to your account at eName Platform, it is a voluntary deposit, and the withdrawal of funds under the account must be handled in accordance with the withdrawal rules of eName Platform. 

5.5.2 If your account balance is insufficient to cover the current service, you will not be able to handle other services rather than payment.

5.6 You need to understand and agree that: If you choose the paid services of eName,  you will be required to pay the fee in accordance with this Agreement or related Rules. If you fail to pay the corresponding fees, eName reserves the right to terminate the services and your account, and in no case is liable for any indirect, incidental, special or consequential damages.

5.7 You understand and agree that; If the domain name you have requested is not  registered successfully, eName will refund the corresponding fee for the domain name to your ID account except where the domain name registry stipulates that it will not be returned. eName will not be responsible for any other responsibilities.

6. User's Rights and Obligations

6.1 You understand and agree that:The domain name registration is strictly carried out in accordance with the registration process of eName. Any registration that is not in accordance with the process is considered as invalid, and the loss caused by the unsuccessful registration of the domain name will be borne by you.

6.2 You understand and agree that: eName will require you to complete the real-name verification according to the requirements of the domain name registries and laws and regulations or the instructions from the higher authorities, and you should submit real domain name registration materials, including but not limited to names or names, Identification documents, ID types, mailing address, contact numbers, email address, etc.. And you promise that the above materials submitted are true, accurate, complete and effective. 

6.3 If your identification information or domain name registration information has changed, you should update it in time. If you fail to submit the verification materials in accordance with the relevant policies and regulations or the requirements of this Agreement or the materials do not meet the relevant requirements of the domain name registry, it is considered as a violation of this Agreement. If the domain name registration is unsuccessful, registered by others or the domain name is suspended, canceled, transferred, etc.due to this, the relevant responsibilities will be borne by you. eName will not refund any payment that have been made and will not bear any responsibility.

6.4 You understand and warrant that: The registered domain name does not infringe the legal rights (including but not limited to other people's trademark rights and domain name rights, etc.) of eName or any other third party. If the domain name you register, use or manage infringes the rights of eName or any third party, you shall bear all responsibilities and compensate for the loss caused to eName. 

6.5 The success of the domain name registration is determined by the domain name registry. eName only handles the registration procedures on its behalf, and does not guarantee any successful registration of the domain name. You do not have any rights to the domain name until you confirm that the domain name registration is successful. After submitting your domain name registration application, you should take the initiative to check the status of the domain name on the domain name registry website.

6.6 You understand and agree that: After you have successfully registered your domain name at eName, you can download the Domain Name Certificate on the domain name management page.However, the Domain Name Certificate does not have the legal effect as a domain name ownership certificate.

6.7 You understand and agree that: You may keep your domain name at eName or transfer it to another domain name registrar that you designate after the domain name registration is successful. However, it must comply with the relevant regulations of the domain name registry and eName.

6.8 You understand and agree that: If your domain name is involved in dispute or domain name information data processing objection, you have the right to file a complaint with the competent authority.

6.9 You understand and agree that: the domain name you register and manage is used reasonably and legally with good faith, and the domain name is not engaged in illegal activities, including but not limited to use the domain name to publish, transmit information that are prohibited by laws and administrative regulations, to harm Internet security and cases identified by the relevant national authorities or domain name registries as illegal or endangering Internet security. Otherwise, eName has the right to take action on your domain name, including but not limited to stop providing domain name services, domain name Lock or ClientHold, etc., and all responsibilities arising from this will be borne by you.

6.10 You understand and agree that: Under the following circumstances, your registered domain name will be suspended, deleted or canceled, and eName will not be held responsible for it:

6.10.1 Failure to comply with the rules or policies of the domain name registry, resulting in the suspension, deletion or cancellation of the domain name;

6.10.2 Violation of relevant laws and regulations and the requirements of this Agreement, causing losses to others or getting into disputes; 

6.10.3 According to the decisions or orders made by the people's courts, arbitration institutions, superior authorities or domain name dispute resolution service providers, the domain name shall be suspended, deleted or canceled. 

6.11 You agree and understand that: You may not use the domain name you have registered to create, upload, copy, publish, transmit or reprint the following content. If you violate the following content, eName has the right to cancel your domain name and reserve the right to pursue legal liability and financial compensation:

6.11.1 Violate the basic principles established by the Constitution;

6.11.2 Endanger national security, leak national secrets, subvert national power, and undermine national unity;

6.11.3 Damage national honors and interests;

6.11.4 Incite ethnic hatred, ethnic discrimination, and undermine ethnic unity;

6.11.5 Destroy the national religious policy and promote cults and feudal superstitions;

6.11.6 Spread rumors, disrupt social order and undermine social stability;

6.11.7 spread obscenity, pornography, gambling, violence, murder, terror or abet crime;

6.11.8 Insult or slander others, infringe the lawful rights and interests of others;

6.11.9 Contain information about other content prohibited by laws or administrative regulations.

7. eName‘s Rights and Obligations

7.1 The search result from eName of whether the domain name is available to register is based on the registration status and the search result from the domain name registry at the time. However, it does not indicate that the domain name can be successfully registered even the result says it is available; eName does not warrant, in any express or implied manner, that the domain name you are applying for registration can be successfully registered.

7.2 If the domain name you applied for registration fails due to the following reasons, eName does not assume any responsibility:

7.2.1 When submitting an application for domain name registration online, the domain name is registered by others;

7.2.2 The domain name is registered by others due to network line and equipment problems;

7.2.3 The registration application is rejected by the domain name registry due to unclear information, resulting in the registration of the domain name by others;

7.2.4 Ownership disputes and problems caused by inaccurate, incomplete and untrue registration information;

7.2.5 The registration application is not submitted in strict accordance with the eName instructions, or the domain name registration fails or is registered by others due to improper filling;

7.2.6 Failure to submit domain name registration materials in strict accordance with the prescribed time limit;

7.2.7 Failure or delay in registration due to system failure or operational error of the domain name registry;

7.2.8 The domain name registry or other person modifies the domain name registration content submitted by you;

7.2.9 All consequences of canceling the domain name registration service due to domain name registry policy changes, technology, etc.;

7.2.10 Your domain name registration fails due to other factors that eName cannot predict or control.

7.3 eName shall take responsibility for the protection of your information security. For specific information protection measures, please refer to the “eName Privacy Policy”.

7.4 eName reserves the right to collect the following information when you use the eName Platform: 

7.4.1 Collect and register your real domain name registration information in accordance with the regulations of the domain name registry and verify it according to the existing verification techniques and methods of eName;

7.4.2 Your trajectory information on the eName Platform, such as browsing behavior, click data, purchased products, account management behavior, and various data that you interact with using Platform services, including analysis data.;

7.4.3 The interaction and consultation information generated by the Platform customer service system when you use the eName Platform service.

7.5 eName is committed to the collection of your relevant information and data for legitimate purposes, including: 

7.5.1 Under the premise of the policy, the domain name registration information collected by eName will be entered into the database and publications that can be queried by the public; If you are a natural person in the EU, the personal information is subject to the General Data Protection Regulation protection, eName will only publicly display your personal information if you give permission or if you request a public display;

7.5.2 Use for the purpose of improving and updating the eName services;

7.5.3 Send you the relevant notices from eName;

7.5.4 Provide to regulatory or law enforcement agencies per their requests;

7.5.5 Other information acquisition applications which eName considers reasonable. 

7.6 You understand and agree that: eName provides services for viewing, updating, and deleting your personal information or domain name and account related settings. If you request to delete your personal data, but this data is required for your use of the services at eName Platform, your request will only be approved if you no longer need to use the eName Platform services that requires the data.

7.7 If you submit a domain name registration or use a domain name in the following situations, eName has the right to reject registration or delete or cancel it; And eName, domain name registries and related service providers have the right to determine whether your behavior fits the following conditions according to relevant rules:

7.7.1 The registration information you submitted according to the policy requirements is untrue, inaccurate, incomplete or not updated in time after change;

7.7.2 Failure to pay the corresponding fees as required;

7.7.3 Violation of the Terms of Service of this Agreement, as well as laws, regulations, rules and policies;

7.7.4 According to the decision, judgment or ruling of the domain name registries, courts or domain name dispute resolution service providers, the registration shall be refused or deleted or canceled;

7.7.5 The registration and use of the domain name causes damage to the interests of eName, domain name registries and related service providers or other third parties.

7.8 If the domain name expires, and you renew or pay the renewal fee beyond the prescribed time limit, eName can still assist you to submit the renewal request to the domain name registry, but does not guarantee a successful renewal.

7.9 eName, domain name registries and related service providers have the right to lock the domain name in the event of a dispute over your domain name, and do not guarantee the outcome of the domain name dispute in any form.

7.10 You understand and agree that: After the domain name registration is successful, eName will add “clientTransferProhibited” and “clientDeleteProhibited” statuses to the domain name in order to protect the security of it, and the statuses will be removed when your transfer request is approved.

7.11 You understand and agree that: After the domain name expires and if you do not renew the domain name within the Auto-Renew Grace Period (45 days after expiration), eName has the right to dispose the domain name (including but not limited to backorder, Auctions, etc.) without any additional notices, and eName is not responsible for this operation.If you have any objections to this, please contact us in time.

8. Usage, Change, Interruption and Termination of Services

8.1 The services provided by eName and its partner companies shall be used in a proper, reasonable and good faith manner. In any of the following circumstances, eName and its partner companies have the right to discontinue or terminate the services provided to you without notice:

8.1.1 The personal data you provided is untrue or inconsistent with the information at the time of registration and you fail to provide reasonable explanation;

8.1.2 Violation of the provisions of relevant laws and regulations or the terms of this Agreement;

8.1.3 According to the provisions of the law or the requirements of the competent authority;

8.1.4 For safety reasons or other necessary circumstances.

8.2 If the network service needs to be suspended due to the needs of system maintenance or upgrade, eName will notify you as far as possible in advance, but if it is necessary to suspend the network service due to unpredictable, temporary, irresistible maintenance or upgrade. eName and its partner companies do not assume any responsibility. 

8.3 You understand and agree that: During the validity period of the domain name, if the domain name is transferred to another domain name registrar other than eName, eNames service obligation is terminated, so is this Agreement.

8.4 eName and its partner companies shall obtain the right to deal with illegal content in accordance with this Agreement. This right does not constitute the obligation or commitment of eName and its partner companies. eName and its partner companies cannot guarantee to discover illegal acts timely or handle accordingly.

8.5 If the following conditions occur, the service period of eName will be terminated early:

8.5.1 Agreed by the two parties;

8.5.2 Otherwise agreed in other contracts signed by the two parties;

8.5.3 If the domain name is transferred to another registrar other than eName;

8.5.4 If the domain name violates the provisions of this Agreement, the laws and regulations or policies of the domain name registry, eName shall stop the service according to the regulations or the decisions and notices made by the relevant institutions;

8.5.5 The domain name registry terminates the service or informs eName to terminate the service;

8.5.6 eName terminates the service in accordance with the ruling of the court or arbitration institution;

8.5.7 Obtaining domain name registration by deception, concealment, etc., or by illegal means;

8.5.8 Failure to pay on time;

8.5.9 The subject qualification of a party does not exist or dies.

8.6 You understand and agree that: eName has the right to suspend or terminate all or part of your account services, or to suspend or cancel your operations (including but not limited to finished or unfinished ones.) under the following circumstances:

8.6.1 The circumstances which may be suspended or terminated under this Agreement;

8.6.2 Suspension or termination in accordance with the provisions of laws, regulations and legal documents;

8.6.3 Requirements of the authorities;

8.6.4 Your use of eName Services is suspected of violating national laws, regulations and administrative regulations;

8.6.5 eName determines that there is an abnormality in account operation or capital in and out base on a unilateral and reasonable judgment;

8.6.6 eName determines that it may cause risks base on a reasonable judgment;

8.6.7 You have registered accounts, credits in bulk and other frauds that violate the rules of activity and the principle of good faith;

8.6.8 You may have illegitimate gains when someone remits funds to your account by mistake ;

8.6.9 You have been complained by others and the other party has provided certain evidences;

8.6.10 You may have incorrectly registered another person's account with real name verification.

8.7 After discovering the above behaviors, eName reserves the right to take one or several of the following measures to eliminate the impact according to its own judgment without prior notice to you, and eName is not liable for breach of this Agreement:

8.7.1 Interrupt your connection to all eName's services or a service and restrict your access;

8.7.2 Lock your ID account, funds or the right to publish information;

8.7.3 Block the IP address you use;

8.7.4 Other measures that can eliminate the impact.

9. Force Majeure and Disclaimer

9.1 eName and its partner company services will be provided in the “as is” status. eName and its partner companies hereby expressly disclaim any express or implied warranties for their services, including but not limited to the applicability, no errors or omissions, continuity, safety, accuracy, reliability, and suitability for a particular use.

9.2 You understand and agree that: eName and its partner companies cannot guarantee that the services they provide are flawless and that they cannot foresee and protect against legal, technical and other risks, including but not limited to system instability, third-party service flaws, government actions, etc. that may result from force majeure, viruses, Trojans, hackers, service interruptions, data loss, and other losses and risks. Therefore, you also agree that even if the services provided by eName and its partner companies are flawed, and the above-mentioned flaws are unavoidable at the time of the industry's technical level, this will not be regarded as a breach of this Agreement by eName and its partner companies. eName and its partner companies shall not be held liable for any loss of data or information caused to you. 

9.3 You understand and agree that: In view of the particularity of the network services, eName reserves the right to change, suspend or terminate some or all of the services at any time without notice to you base on the overall operation of eName Platform or related operational practices, rules, etc.. eName does not need to be responsible for you or a third party.

9.4 You understand and agree that: In order to provide you with better services, eName has the right to examine, maintain and upgrade the Platform or related equipment that provides the services on a regular or irregular basis. If the services are interrupted or suspended within a reasonable time, eName and its partner companies are not responsible for this.

9.5 You understand and agree that: eName and its partner companies are not responsible for any loss to you due to interruption or block of service caused by:

9.5.1 The unauthorized use of your account or change of your data by a third party ;

9.5.2 Your misunderstanding of the service of eName and its partner company or the loss caused by your own operation error;

9.5.3 Reasons other than within the reasonable scope control of eName and its partner companies, including but not limited to equipment maintenance for normal information network, information network connection failure, computer, communication and other system failures, power failures, natural disasters such as floods, earthquakes, plague epidemics and storms, and social events such as strikes, labor disputes, riots, uprisings, riots, lack of productivity or production data, wars, turmoil, government actions, etc.

9.6 Under no circumstances should you believe in asking for a loan, passwords or other internet information related to your property; For operations involving your property, please check the identity of the other party first, and always pay attention to the reminder from eName to prevent fraud.

9.7 You understand and agree with eName here: In any case, if you suffered loss due to eName’s breach of contract during your use of the service, the total amount of eName’s compensation to you shall not exceed the total amount of service fee you have paid for the corresponding service.

10. Minor Terms of Use

10.1 If you are under the age of 18, you are a minor and should read this Agreement and use the Service under the supervision and guidance of the Guardians. 

10.2 Minor users should pay attention to the following matters when using this Service to improve safety awareness and strengthen self-protection: 

10.2.1 Recognize the difference between the online world and the real world, avoid indulging in the network and affecting the daily learning life;

10.2.2 Strengthen personal protection awareness when filling in personal data, to avoid harassment of personal life by bad people;

10.2.3 Learn to use the Internet correctly under the guidance of the Guardians or teachers;

10.2.4 Do not meet unfamiliar net friends or participate in social activities at will, which might give bad people a chance to take advantage of you and endanger your safety.

10.3 Guardians and schools should give more guidance to minors when using this Service; Parents, in particular, should care about the growth of their children, pay attention to communication, and guide their children to pay attention to the safety issues on the Internet, and prevent problems before happening.

11. Intellectual Property Statement

11.1 The intellectual property rights provided by eName in the Service (including but not limited to web pages, text, images, audios, videos, graphics, etc.) are owned by eName, and the intellectual property rights of the content you generate in the use of the Service is owned by you or the relevant rights holder. 

11.2 Unless otherwise stated, eName's trademark rights, copyrights, patents and other intellectual property rights of the software upon which the Service is provided are owned by eName.

11.3 The copyright or trademark rights of the commercial logo used by eName in the Service  belongs to eName.

11.4 The intellectual property rights of the above and any other content contained in the Service are protected by law and no one may use or create related derivative works in any form without the written permission of eName, users or related rights holders.

12. Jurisdiction and Application of Law

12.1 The signing place of this Agreement is Siming District, Xiamen, Fujian Province, the People's Republic of China.

12.2 The formation, take effect, fulfillment, interpretation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If there is no relevant law, it should refer to the general domestic industry practice. 

12.3 If there is any dispute between you and eName and its partner companies, first of all, it should be resolved through friendly negotiation. If the negotiation fails, you agree to submit the dispute to the jurisdiction of the people's court where this Agreement is signed. 

12.4 The headings of all the terms of this Agreement are for reading convenience only and have no actual meaning and cannot be used as a basis for interpretation of the meaning of this Agreement.

12.5 Any provision of this Agreement shall be deemed to be revoked, invalid or unenforceable. This provision shall be deemed to be separable and shall not affect the validity and enforceability of the remaining provisions of this Agreement, and the remaining provisions shall remain binding on both parties.

13. Supplementary

13.1 The contents of this Agreement, including the above terms and various types of agreements that have been issued or may be issued in the future by eName, are considered to be an integral part of this Agreement and have the same legal effect. When you use the Service, you have read, understood and accepted all the terms and conditions of this Agreement, and promised to abide by the various legal provisions of China. If there is any legal liability caused by the violation, you will bear the corresponding legal responsibility in your own name.
